EMLab P&K's Products Sweepstakes
NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
- ENTRY PERIOD: EMLab P&K's Products Sweepstakes ("Sweepstakes") begins at 12:01 a.m. Pacific Standard
Time ("PST") on January 17, 2011 and ends at 11:59 p.m. PST on March 31, 2011 ("Entry Period").
- HOW TO ENTER: There are two (2) ways to enter: 1) Complete a Purchase: During the Entry Period, you may
purchase products from EMLab P&K to receive one entry into the Sweepstakes. You will receive one entry for each tier you
qualify for when you complete a products purchase from EMLab P&K during the Entry Period. Orders totaling over $250
qualify for "Tier 1" prizes. Orders totaling $151 up to and including $250 qualify for "Tier 2" prizes.
Orders totaling $75 up to and including $150 qualify for "Tier 3" prizes. Orders totaling less than $75 do not
qualify for entries into the Sweepstakes. Amount of order is defined as the total purchase after discounts and refunds, and
excludes the cost of shipping and handling. Or, 2) NO PURCHASE NECESSARY: To enter Without Completing a Purchase:
On a 3" x 5" piece of paper, hand-print your full name, date of birth, name of your company/organization, complete address,
e-mail address, daytime and evening telephone numbers, and specify which tier ("Tier 1," "Tier 2," or
"Tier 3") you would like to enter, and mail in an envelope no larger than #10 (business-size envelope) with
sufficient postage affixed, to: EMLab P&K Products Sweepstakes, 1150 Bayhill Drive, Suite #100, San Bruno, CA 94066.
Entries must be postmarked by March 25, 2011 and received by March 29, 2011. Limit one entry per envelope per tier per day
during the Entry Period. Entries are limited to one (1) entry per person per tier per day with a maximum of three (3) entries
(one (1) entry in each of the three (3) tiers) per day, regardless of method of entry. All entries become the property of
Sponsor and will not be acknowledged or returned. No entries may be submitted on behalf of another person. An entrant may
not enter with multiple identities. Entries will be applied to the Sweepstakes on the day the entry is received. Any entrant
who attempts to circumvent these rules by entering with multiple identities or using any device or method to obtain more
than the maximum number of entries will be disqualified. Use of any robotic, automatic, programmed or similar entry method,
more than one entrant per household or more than the allowed number of entries will void all entries and result in disqualification.
- ELIGIBILITY: Open only to persons employed in environmental services or the IAQ industry and who are at least
eighteen (18) years old at the time of entry. Employees and directors of EMLab P&K ("Sponsor") and its affiliates,
advertising agencies, and/or promotional partners and members of their immediate families together with whom such employees
are domiciled are not eligible to enter or win. Void where prohibited.
- RANDOM DRAWING: Winners will be selected in a random drawing held on or about April 1, 2011 from among all eligible
online and mail-in entries received. Drawing will be conducted by Sponsor. Odds of winning will depend upon the number of
eligible entries received. Winner will be notified by either e-mail, mail, or telephone and may be required to sign and return
an Affidavit of Eligibility, Release of Liability and a Publicity Release within seven (7) days of attempted delivery or prize
will be forfeited and an alternate winner may be selected, at Sponsor's sole discretion. The return of any prize/prize
notification as undeliverable will result in disqualification and an alternate winner may be selected. An entrant is not
deemed a winner of any prize, even if the winning notification should so indicate, unless and until the entrant's eligibility
has been verified, all required documents returned and executed, and the entrant has been notified that the acceptance and
verification process is complete.
- PRIZES: One (1) Tier 1 First Prize: 16GB Wi-Fi Apple iPad® (or as an alternative, the winner may choose
$500 credit to spend at EMLab P&K's store. ARV: $500.
One (1) Tier 1 Second Prize: Zefon Bio-Pump® Plus. ARV: $729.
One (1) Tier 1 Third Prize: Protimeter Surveymaster™. ARV: $599.
One (1) Tier 2 First Prize: Mold Inspection Kit (EMLite II). ARV: $449.
One (1) Tier 2 Second Prize: Protimeter HygroMaster™. ARV: $389.
One (1) Tier 2 Third Prize: Extech™ Humidity and Temperature USB Datalogger (RHT20). ARV: $130.
One (1) Tier 3 First Prize: Fifty (50) Zefon Air-O-Cell® cassettes. ARV: $209.
One (1) Tier 3 Second Prize: Extech™ Humidity and Temperature USB Datalogger (RHT10). ARV: $85.
One (1) Tier 3 Third Prize: One GIANTmicrobes® GIGANTIC plush doll. ARV: $30.
Total approximate retail value ("ARV") of all prizes: $3,120 USD.
Prize consists of only those items specifically listed as part of the prize. Limit one prize per family, household, company, or organization.
No substitution or transfer of prize permitted by winner. Sponsor reserves the right to substitute a prize of equal or greater value.
Unclaimed prizes will not be awarded.
- GENERAL RULES: All income taxes resulting from acceptance of prize are the sole responsibility of winner. By entering Sweepstakes,
entrant accepts and agrees to these Official Rules and the decisions of Sponsor, which shall be final in all matters. By accepting prize,
winner agrees to hold Sponsor, its affiliates, directors, officers, employees and assigns harmless against any and all claims and liability
arising out of use or redemption of prize. Acceptance also constitutes permission to the Sponsor to use winner's name, likeness and
biographical information for marketing purposes without further compensation or right of approval, unless prohibited by law. Sponsor is not
responsible for lost or late mail, or for technical, hardware or software malfunctions, lost or unavailable network connections, or failed,
incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or
programming associated with or utilized in this Sweepstakes, or by any human error which may occur in the processing of the entries in this
Sweepstakes. If, in the Sponsor's opinion, there is any suspected evidence of tampering with any portion of the promotion, or if technical
difficulties compromise the integrity of the promotion, the Sponsor reserves the right to modify or terminate the sweepstakes in a manner
deemed reasonable by the Sponsor, at the Sponsor's sole discretion. In the event a dispute arises as to the identity of a potentially winning
online entrant, entries made by internet will be declared made by the name on the online entry form. Potential winner may be required to show
verifiable proof of identity. All federal and state laws apply.
- SPECIAL RULES RESIDENTS OF CANADA & UK.
a. For residents of Canada: If you are a potential winner you will be required to correctly answer, without assistance of any kind, whether
mechanical or otherwise, a time-limited mathematical skill-testing question to be administered by either telephone or e-mail. If you answer
the skill-testing question incorrectly, as determined by us in our sole discretion, you will be disqualified and, at our discretion, an
alternate winner shall be chosen from among all remaining eligible entries.
b. For residents of the United Kingdom: Provisions of the Contracts (Rights of Third Parties) Act 1999 shall not apply to this agreement.
- DISPUTES; GOVERNING LAW. Except where prohibited, the entrant agrees that any and all disputes, claims and causes of actions
arising out of or connected with the Sweepstakes or any prize shall be resolved on an individual basis without resort to any form of class action.
Any and all disputes, claims and causes of actions shall be resolved exclusively by the United States District Court for the Northern District
of California, or the appropriate California State Court located in San Mateo County, California. Any issues or questions of construction,
interpretation, validity, or enforceability of these rules, or the rights and obligations of the entrant and/or Sponsor in connection with the
Sweepstakes shall be governed by, construed and interpreted in accordance with the laws of the State of California, without giving effect to
any choice of law or conflict of law rule which would cause the application of the laws of any jurisdiction other than the State of California.
Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the
Sweepstakes but in no event attorneys' fees. Entrant hereby waives all rights to claim punitive, incidental, and consequential damages and any
other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some
jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
- WINNER'S LIST: For the name of the winner, available after April 15, 2011 send a self-addressed, stamped (#10) envelope with
